“I Antonio Pereira Vittorino de Barres, a native of Cape de Verde islands and a subject of Portugal, at present residing at Apia, Samoa, being of sound disposing mind memory and understanding do hereby make this my last Will and Testament hereby revoking all and every other Will or Wills heretofore made by me.”
1. I desire that all my just debts [unintelligible] and testamentary expenses be paid out of my real and personal estate, by my executors, herein after named, as from as may be after my decease.
2. I leave and bequeath in trust of my son Antonio and Montgomery Betham, a British subject, for the benefit of my children; Caroline, Rose, Antonio, Beato, Paulo and … for their use and benefit with this proviso, that the piece of land, now bequeathed cannot be sold by any of my aforementioned children, their heirs or descendents for ever. That piece of land situate at Savalalo, Apia, Samoa, called Afuua as per deed together with all buildings, [unintelligible] and opportunities [unintelligible] to belonging: But subject to the following conditions viz that if my son José Pereira shall so desire he may erect a dwelling house and reside on a part of the said land, which must be to the south ward of the line of the inland or southern bounded fence of the ‘Gentile Handels’ and Plantagen Gesellchaft’ the afore described right will descend to his heirs and descendents of José Pereira for ever.
3. I leave and bequeath to my son José Pereira one acre of my land called ‘Fatipule’ to be selected by him either North, South, East or West.
4. I leave and bequeath to my son José Pereira the one half part of my island of Fonualoa of the Tokelau Group the first choice to be given to my said son José Pereira
5. All my land called ‘Fatipule’([unintelligible] and except the one acre devised to my son José Pereira in clause 3 afore written) together with my land called ‘Le Fusi’ and also one half part of my land of Fonualoa together with all the rest and remainder of my personal estate of whasoever nature it may be, I leave and bequeath in trust to my son Antonio and Montomery Betham for the benefit of my children, Caroline, Rose, Antonio, Beato, Paulo and James
6. I hereby appoint my son Antonio and Montgomery Betham to be executors of this my last will.
